Lender Not Responding to Your Short Sale? The Deadlines Servicers Must Meet and How to Escalate

Federal rules give mortgage servicers written deadlines on loss mitigation applications, information requests and short sale offers. How to use them.

Last reviewed October 7, 2026

If your lender has stopped responding to your short sale or loss mitigation application, federal servicing rules give you written deadlines to point to. A servicer must acknowledge an application received 45 days or more before a foreclosure sale within 5 days, not counting weekends and federal holidays, and must evaluate a complete application received more than 37 days before a sale within 30 days (12 CFR 1024.41). On a Fannie Mae loan, the servicer must answer a short sale offer in writing within 30 calendar days of a complete package (Servicing Guide D2-3.3-01). The calm way to restart a stalled file is in writing.

These rules control the process, not the answer: nothing in section 1024.41 requires a servicer to offer any particular option (1024.41(a)). The loss mitigation procedures apply only to a loan secured by your principal residence (1024.30(c)(2)), and servicers that qualify as small servicers are exempt from most of them (1024.30(b)(1)).

The clocks a servicer is held to

Four written deadlines cover most stalled short sale files.

  • Acknowledgment. If your application arrives 45 days or more before a foreclosure sale, the servicer must tell you in writing within 5 days, excluding weekends and legal holidays, whether it is complete, and if not, list the missing documents and a reasonable date to send them (1024.41(b)(2)).
  • Evaluation. For a complete application received more than 37 days before a sale, the servicer has 30 days to evaluate you for all available options and tell you in writing which options, if any, it will offer (1024.41(c)(1)).
  • Waiting on someone else. If the servicer needs documents from a third party, it cannot deny a complete application solely for lacking them, and must tell you in writing what it lacks and that it has asked (1024.41(c)(4)).
  • Fannie Mae short sale offers. The servicer must acknowledge an initial offer within five business days, respond in writing within 30 calendar days of a complete borrower response package plus the offer (approve, counter, or decline), and answer a revised offer within ten business days (D2-3.3-01).

The full seller timeline is in how long a short sale takes.

A complete application is what starts the 30 days

Most “no response” files are files the servicer still considers incomplete. The acknowledgment notice names what is missing and the date to send it. Check it against the short sale documents checklist, send the missing items together, keep copies, and write down the date and method you sent them.

Who you should be able to reach

Servicers must have policies to assign personnel to a delinquent borrower no later than the 45th day of delinquency (12 CFR 1024.40). Those policies must also make the staff reachable by phone, with a live response in a timely manner if you cannot reach them right away; the staff should be able to tell you your application’s status, the deadlines that apply, and how to send a notice of error or a request for information.

Log every call: date, name, and what was said. If a phone promise matters, ask for it in writing.

Put the question in writing

A written request for information starts its own clock: acknowledgment within 5 days and a response within 30 days, not counting weekends and federal holidays (12 CFR 1024.36). It needs your name, enough to identify the loan, and the information you want, such as your application’s status and anything still missing. Send it to the servicer’s designated address for these requests, if it has one. The servicer can extend the 30 days by another 15, if it tells you in writing before the 30 days end, and cannot charge a fee to respond.

If you believe the servicer made a mistake, such as giving inaccurate information about loss mitigation options, a written notice of error carries the same 5-day acknowledgment and, in most cases, a 30-day response (12 CFR 1024.35).

Neither letter is a pause button. A servicer may continue a foreclosure while a request for information is pending (1024.36(h)), and a notice of error does not stop a foreclosure except for the specific foreclosure-timing errors the rule lists (1024.35(i)).

The foreclosure limits, briefly

The rule restricts foreclosure steps while a complete application is under review, depending on when it arrived (12 CFR 1024.41(f) and (g)). A servicer generally cannot make the first foreclosure filing until the loan is more than 120 days delinquent. A complete application received before that filing blocks it, and one received after the filing but more than 37 days before a sale bars a motion for judgment or a sale, until the servicer denies the application and any appeal is over, you reject the options offered, or you do not perform under an agreement.

The appeal right in 1024.41(h) covers denials of loan modification options, not short sale decisions. Whether these protections apply to your file, and what to do if a servicer ignored them, are questions for a Florida attorney.

Escalate calmly, in this order

  1. Your written request, sent to the designated address, with a copy kept.
  2. A HUD-approved housing counselor, an agency the CFPB says can offer independent advice, often at little or no cost. See our housing counselor page.
  3. A CFPB complaint at consumerfinance.gov/complaint. The CFPB forwards mortgage complaints to the company and says most companies respond within 15 days. You generally get one complaint per problem, so attach your log and letters.
  4. An attorney, if a foreclosure case is moving or you believe the rules were not followed.

Be cautious with anyone who asks for money to make the servicer respond (foreclosure rescue scams). Once the servicer answers, after short sale approval covers what the letter must say.

Common questions

How long does a lender have to respond to a short sale offer?

It depends on who owns the loan. On a Fannie Mae loan the servicer must acknowledge an initial short sale offer within five business days, respond in writing within 30 calendar days of receiving a complete borrower response package and the offer, and answer any revised offer within ten business days (Servicing Guide D2-3.3-01). Separately, federal rules require a servicer to evaluate a complete loss mitigation application received more than 37 days before a foreclosure sale within 30 days (12 CFR 1024.41(c)(1)).

Does the 30-day clock start when I send my first documents?

No. The 30-day evaluation runs from the day the servicer has a complete application. If your application arrives 45 days or more before a foreclosure sale, the servicer must tell you in writing within five days, not counting weekends and federal holidays, whether it is complete and, if not, which documents are missing and the date to send them (12 CFR 1024.41(b)(2)). That letter is your to-do list.

Can I appeal if my short sale is denied?

The federal appeal right covers denials of loan modification options, not short sale decisions. It applies when a complete application was received 90 days or more before a foreclosure sale: you get 14 days to appeal, different staff review it, and the servicer answers within 30 days (12 CFR 1024.41(h)). For a short sale, you can ask in writing for the reasons and submit a revised offer, which on a Fannie Mae loan must be answered within ten business days.

Will sending a letter to my servicer stop a foreclosure?

Not by itself. A servicer may continue a foreclosure while a request for information is pending (12 CFR 1024.36(h)), and a notice of error does not stop a foreclosure except for the specific foreclosure-timing errors the rule lists (12 CFR 1024.35(i)). The foreclosure limits that do exist depend on when a complete loss mitigation application was received. Whether they apply to your case is a question for a Florida attorney.

Who am I supposed to be able to reach at the servicer?

Servicers must have policies to assign staff to a delinquent borrower no later than the 45th day of delinquency, make them reachable by phone, and provide a live response in a timely manner when you cannot reach them right away (12 CFR 1024.40). Those staff should be able to tell you the status of your application and any deadlines. Ask for your assigned contact by name and log every call.

Does a CFPB complaint help?

It puts your file in front of the company through a formal channel. The CFPB accepts mortgage complaints, forwards them to the company, and says most companies respond within 15 days. You generally cannot submit a second complaint about the same problem, so include your key dates and attach your letters and the servicer's replies.
